When the United States Immigration and Customs Enforcement ("ICE") or Department of Homeland Security ("DHS") takes custody of an individual pending the outcome of deportation proceedings, that is referred to as an "immigration detainer". Reasons for Issuance of a Detainer
There are several scenarios in which a Permanent Resident (e.g. Green Card Holder), Visa Holder or undocumented alien may be detained. The classic instances are upon:
1. Returning From Travel Abroad and Some Basis for Removal or Inadmissibility is Discovered;
2. Applying for, Renewing or Inquiring Regarding Immigration Status (e.g. renewing a Green Card or Visa, applying for citizenship or Permanent Residency, etc.) and a basis for Criminal Deportation is revealed;
3. Involvement with the Criminal Justice System (e.g. Stopped by Police, Arrested, Incarcerated or Subjected to Probation or Parole) with respect to an Aggravated Felony, Crime of Moral Turpitude, or some other Removable Offense.
Relief from an Immigration Detainer
If someone has been placed in a jail or prison because of a detainer issued by DHS or ICE, our attorneys have several options to assist a client.
